Please read these Terms and Conditions (“Terms”) carefully before using the divasclub.in website, our styling app at app.divasclub.in, and all associated subdomains and services (collectively, the “Service”) operated by Emporia Gusto Private Limited (“Divas Club”, “us”, “we”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

1. Definitions

• “Personalised Style Report” means the custom styling analysis created by our AI-powered styling system based on your photographs and questionnaire responses, including face shape analysis, body type analysis, colour palette, outfit recommendations, and related style guidance.
• “Styling Services” means all personalised styling services offered on our platform, including Daily Styling, Power Styling, Vacation Styling, Wedding Guest Styling, Daughter Styling, Festive Styling, and any add-on services such as Wardrobe Mix & Match and Outfit Previews.
• “Styling Platform” or “App” means our self-serve web application at app.divasclub.in through which you submit your details, receive your styling analysis, and access all purchased styling services.
• “Aarya” means our AI-powered styling assistant that provides post-service support and styling advice.
• “User” or “You” means any individual who accesses or uses the Service.

2. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are accessing the Service on behalf of another person, you represent that you have the authority to bind that person to these Terms.

3. Our Styling Service

3.1 How It Works

Divas Club provides a personalised styling service delivered through our self-serve platform. When you book a styling service, you will be asked to submit photographs and complete a styling questionnaire through our app (app.divasclub.in). Our AI-powered styling system then analyses your face shape, body type, skin tone, colour season, and other features to create personalised style recommendations tailored specifically to you.

3.2 Service Delivery

All styling services are delivered through our online platform at app.divasclub.in. After payment and completion of your submission (photographs and questionnaire), your personalised styling analysis will be available in your account within the timeframe stated on the service page. You will receive lifetime access to your styling recommendations through the platform.

By uploading photographs to our Service, you confirm that:

• The photographs are of yourself and you have full rights to submit them.
• You consent to the AI analysis of these photographs for the purpose of creating your personalised styling service.
• You understand that photographs are processed by automated AI systems.
• You have read and understood our Privacy Policy regarding photo handling and storage.

4. Service Fees & Pricing

4.1 Pricing

All prices displayed on the Service are exclusive of applicable Goods and Services Tax (GST). GST at the prevailing rate will be added to the base price at the time of checkout. The total price payable (including GST) will be clearly displayed before you confirm your booking.

• Daily Styling (Personalised Style Report): ₹1,999 + applicable GST.
• Power Styling: ₹1,499 + applicable GST.
• Vacation Styling: ₹1,299 + applicable GST.
• Wedding Guest Styling: ₹2,499.
• Daughter Styling: ₹1,499 + applicable GST.
• Festive Styling: Prices as listed on the service page.

We reserve the right to change prices at any time without prior notice. Price changes will not affect services already booked.

4.2 Payment

Payments are processed through secure, PCI-DSS compliant third-party payment gateways. We do not store your credit card or banking information on our servers. By making a payment, you represent that you are authorized to use the chosen payment method.

4.3 Invoice

A tax invoice including GST details will be provided for every booking via email upon successful payment.

5. Service Access & Usage

Upon booking a styling service:

• Your personalised styling analysis will be available through our platform (app.divasclub.in) within the timeframe stated on the service page (typically within 30 minutes of completing your submission).
• You receive a personal, non-exclusive, non-transferable right to access and use the styling recommendations for your own personal, non-commercial purposes.
• You may not reproduce, distribute, resell, share, or create derivative works from any styling content provided through the service.
• Lifetime access to your styling content is provided through the platform as long as the service is operational.

6. Cancellation & Refund Policy

Cancellations and refunds are governed by our Cancellation & Refund Policy. By booking a service, you acknowledge that you have read and agreed to the policy. Key points:

• Personalised styling services are non-refundable once the analysis has been created and made available to you.
• If the analysis has not been provided within 48 hours of your complete submission, you may request a full refund.
• You may cancel before submitting your photographs and receive a full refund.

7. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Submit photographs of anyone other than yourself without their explicit consent.
• Attempt to reverse-engineer, decompile, or otherwise access the AI models or underlying technology.
• Share, redistribute, or resell any styling content or reports accessed through the Service.
• Use automated tools (bots, scrapers) to access the Service.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Provide false, inaccurate, or misleading information in your questionnaire or photo submissions.

8. Intellectual Property

The Service, including all original content, styling algorithms, AI models, templates, design elements, and software (excluding user-submitted content), is the exclusive property of Emporia Gusto Private Limited and is protected by Indian copyright, trademark, and intellectual property laws.

“Divas Club”, “Aarya”, the Divas Club logo, and related marks are trademarks of Emporia Gusto Private Limited. You may not use these marks without our prior written consent.

Your personalised styling content is licensed to you for personal use. Emporia Gusto Private Limited retains ownership of the format, design, and underlying methodology.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.
• We do not warrant that the Service will be uninterrupted, secure, or error-free.
• Styling recommendations are subjective suggestions and we make no warranty regarding their suitability for any particular purpose.
• In no event shall Emporia Gusto Private Limited, its directors, employees, partners, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses.
• Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us for the specific service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Emporia Gusto Private Limited, its directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation a breach of these Terms. Upon termination, your right to use the Service will immediately cease, but your obligation to pay for services already booked will remain.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

Before initiating any legal proceedings, you agree to first attempt to resolve any dispute by contacting us at hello@divasclub.in. We will attempt to resolve the dispute within 30 business days.

13. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. Material changes will be notified via email or a notice on the Service. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, Cancellation & Refund Policy, and Service Delivery Policy, constitute the entire agreement between you and Emporia Gusto Private Limited regarding the use of the Service.
